Welcome. Endless Rally is operated by Swell Farms Inc., a company registered in British Columbia, Canada ("we", "us", or "Swell Farms"). By accessing or using Endless Rally at endlessrally.com or any related service (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.
Endless Rally is a motorcycle maintenance logbook and a public mileage leaderboard. You can record your bike's service history, modifications, fuel stops, parts, and odometer updates. You can choose to display your bike publicly on the leaderboard. The Service is a record-keeping tool only. It is not mechanical advice, safety guidance, part-compatibility verification, or professional service. Always follow your bike manufacturer's service intervals and instructions, and consult a qualified mechanic for anything mechanical, safety-related, or legally regulated.
Motorcycling is inherently dangerous. By using the Service, you acknowledge and agree that:
You own the content you upload — bike photos, log entries, notes, part numbers, everything. We claim no ownership over it.
By uploading content, you grant Swell Farms Inc. a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, cache, back up, and display your content solely for the purpose of operating the Service as you've configured it (for example, displaying your public bike on the leaderboard if you marked it public, or serving your log entries back to you on the dashboard). This license ends when you delete the content, except for copies retained in routine backups (which age out within 14 days) or where retention is required by law.
You can export or delete your data at any time. See the Privacy Policy for details.
All software, source code, designs, brand assets, logos, trademarks, layouts, text, graphics, and anything else that makes up the Service itself is owned by Swell Farms Inc. or licensed to us. You do not get any right to copy, modify, distribute, reverse-engineer, decompile, disassemble, resell, sublicense, or create derivative works of the Service. You may not use our name, logo, or branding to imply endorsement without written permission.
You agree not to:
Violating any of the above may result in immediate suspension or termination of your account, without notice and without refund.
The leaderboard ranks bikes by kilometers ridden since account creation. It operates on the honor system, subject to dispute verification. There is no prize money, no formal sanctioning, and no competition governing body. Rankings are entertainment and community feature only — not a record of official race or rally results.
Endless Rally is currently in beta. During beta the Service is free and all features are unlocked. After beta, a paid subscription will be introduced (currently slated at $2.50 CAD/month). We will give registered users advance written notice by email before any charges begin, and you may cancel or delete your account at any time without cost during beta.
Founding Riders promise: the first 2,000 registered accounts (by database insertion order, tracked via founding_rider_number) are grandfathered into a permanent rate of $1.50 CAD/month when paid subscriptions launch, for the life of the account, as long as the subscription stays active and in good standing. If you cancel and re-subscribe later, you rejoin at the then-current standard rate. Founding Rider status is non-transferable and does not survive account deletion.
What the Founding Rider rate covers: the core logbook and leaderboard features available on the day paid subscriptions launch — bikes, service logs, mod logs, fuel logs, mileage logs, parts library, public rider profile, shareable bike history. These core features will not be moved behind a paywall upgrade for Founding Riders.
Future add-on products are separate: we may launch additional products, tiers, or premium modules (for example: GPS ride tracking, route mapping, PDF export, email reminders, advanced analytics, fleet/shop accounts, marketplace features). Those are separately priced and not included in the Founding Rider base rate. Your choice to add them is always optional.
When paid subscriptions launch, payments will be processed by Stripe Inc.. Swell Farms Inc. does not see or store your credit card number; Stripe handles all card data per its own terms and privacy policy. You authorize us (through Stripe) to charge your payment method on the recurring billing cycle you select.
No refunds policy. Subscription fees are non-refundable, including for partial months of service. If you cancel, your subscription remains active until the end of the current billing period and is not renewed thereafter. Annual subscriptions (if offered in the future) are non-refundable after 14 days.
Chargebacks. Filing a credit card chargeback or payment dispute against a Swell Farms charge, without first contacting us to resolve the issue at fun@endlessrally.com, may result in immediate termination of your account and loss of access to your data. We reserve the right to recover chargeback fees, processing costs, and any owed amounts through legal means.
The Service is provided on an "as is" and "as available" basis. We make reasonable efforts to keep it online but we do not guarantee uptime, performance, accuracy, completeness, or fitness for a particular purpose.
We reserve the right to, at any time and in our sole discretion:
We are not liable for any modification, suspension, or discontinuation of the Service. If we permanently shut down, we will give registered paid users reasonable notice and an opportunity to export their data.
The Service relies on third-party infrastructure providers including but not limited to Supabase (database + authentication), Cloudflare (storage + CDN + worker), Resend (transactional email), Stripe (payments, future), and UptimeRobot (uptime monitoring). We are not responsible for the acts, omissions, outages, data practices, or terms of these third parties. Their own terms and privacy policies govern their handling of data they process on our behalf.
The Service may contain links to third-party sites (for example, RevZilla affiliate links on service log entries, or external community links on the Riders Hub page). We are not responsible for the content, terms, or practices of any third-party site.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. We do not warrant that the Service will meet your requirements, be error-free, that data will not be lost or corrupted, or that results obtained from using the Service will be accurate or reliable. Back up anything you cannot afford to lose.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Swell Farms Inc. and its officers, directors, employees, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including reasonable legal fees) arising from or related to: (a) your use of or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity; (d) any content you submit to the Service; or (e) any claim that your motorcycle operation, maintenance, or modification caused loss, injury, or damage to any person or property.
If you believe content on the Service infringes your copyright, send a written notice to fun@endlessrally.com with the subject line "Copyright Complaint" including:
We will review notices promptly and remove infringing content where appropriate. Users whose content is repeatedly subject to valid copyright complaints may have their accounts terminated.
Some service log entries display links to RevZilla. We may earn a small affiliate commission if you purchase through those links. The commission does not change the price you pay and does not affect our editorial decisions about which categories to link.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the courts of British Columbia located in Victoria or Vancouver, and you consent to personal jurisdiction in those courts.
Class action waiver: you agree to resolve disputes with us on an individual basis only. You waive any right to bring or participate in a class action, collective action, or representative proceeding against Swell Farms Inc., to the maximum extent permitted by applicable law.
We may update these Terms occasionally. When we change them materially, we will update the "Last updated" date at the top and notify registered users by email and/or an in-app banner. Continuing to use the Service after the change means you accept the revised Terms. If you don't agree, stop using the Service and delete your account.
You may delete your account at any time by emailing fun@endlessrally.com. We will wipe your personal data within 7 days, subject to routine backup aging and any legal retention requirement.
We may suspend or terminate your account at any time, with or without notice and at our sole discretion, if you violate these Terms, engage in fraud, or if we reasonably determine your continued use poses risk to the Service or other users. Termination ends your right to use the Service but does not relieve you of any obligation incurred prior.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of the Terms will remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Swell Farms Inc. regarding the Service and supersede any prior agreements, representations, or communications (oral or written) between us regarding the Service.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law, with notice to you where practical.
